A rose by any other name would still violate the patent.

The CBC News reports that a patent fight concernign canola seeds heads to Supreme Court of Canada.

Of particular interest in this case, where lower courts have ruled that a farmers unintentional use plants grown from genetically modified canola seeds violated a patent held by Monsanto.

Who can patent life, and who owns life – whether it's seeds, plants, animals and so on?" Percy Schmeiser, the aggrieved farmer, said Monday at a news conference.
